Prosecutions & Enforcement

Maddocks has long been recognised as a leader in the area of prosecution and enforcement law on behalf of local government and other statutory authorities. The firm regularly receives instructions in relation to breaches of Food Law, Building Law, Traffic Law, Planning Law and other similar areas where there is a regulatory framework. For example, we are retained by Vicroads to manage and conduct enforcement litigation relating to the trucking industry across Victoria.

Unlike many law firms, the lawyers at Maddocks conduct most of their own advocacy. This is particularly true in the case of planning enforcement, and other prosecution enforcement procedures before courts and tribunals. This results in significant cost savings to our clients. In-house advocacy is consistent with our commitment to close and focused relationships with our clients.

In addition to appearing at most interlocutory hearings in mainstream litigation, the great majority of appearance work is undertaken by our lawyers in the:

presentation of applications for enforcement orders and other matters before the Victorian Civil and Administrative Tribunal
appearing at hearings of the Anti Discrimination List of VCAT, federal Human Rights and Equal Opportunity Commission, Australian Industrial Relations Commission and Federal Court of Australia

preparation and conduct of hearings at the Liquor Licensing Commission

conduct of appeals and applications for modification before the Building Appeals Board.

Our lawyers also make regular appearances in Magistrates' Courts throughout Victoria.
