Background

Bronwyn has been a member of the Construction & Major Projects group at Maddocks for 11 years. She specialises in the area of Administrative law, Prosecutions and Enforcement.

She acts for State and Local Government advising on regulatory and compliance issues. Bronwyn has extensive experience in disciplinary tribunal work, merits and judicial reviews.

She has given comprehensive advice to various Government agencies on policy and regulatory regimes. Bronwyn has experience as an advocate. She provides advice on Prosecutions and Enforcement at all stages of the process.

Bronwyn is a member of the Building Regulations Advisory Committee (BRAC), a statutory Committee made up of industry representatives for the purpose of advising government on the Building Regulations 2006. Bronwyn was first appointed to the BRAC in 2001 and again in 2007.

Relevant Experience

  • Significant experience in providing advice on the interpretation of legislation and on policy and strategic issues relating to the area of building regulation in Victoria.  In this capacity, has provided detailed advice to the MFESB on its enforcement powers and functions, to the Building Commission on owner builders, insurance issues, dispute resolution and Act amendments generally
  • Bronwyn has been involved in the preparation of manuals for the Building Practitioners Board, Building Appeals Board, Complaints Assessment Unit and the MFESB relating to powers and functions
  • Regularly advising Councils and their statutory obligations and liability issues
  • Regularly acts for the Building Practitioners Board on a range of legal issues relating to the conduct of disciplinary inquiries and Board powers and functions
  • Regularly acts for the Architects registration Board of Victoria in relation to complaints, disciplinary inquiries and that Board's powers, procedures and functions
  • Has appeared in the Magistrates' Court as prosecutor for the Building Commission, CoINVEST and for various local councils.  Broad experience in assessing and advising on evidence and drafting charges for offences under the Building Act 1993, Building Regulations Act 1994 and Domestic Building Contracts Act 1995
  • Involvement in appeals to the Building Appeals Board on behalf of the Building Practitioners Board and local councils
  • Acts for CoINVEST (Construction Industry Long Service Leave Fund) managing over 400 prosecutions each year
  • Appointed to the Building Regulations Advisory Committee in 2001 and again in 2007 and 2009.
