A lot has happened over the last couple of months and 2011 appears to be a year of change and new issues. Of interest is the change in government and the recent statement in relation to illegal brothels. This will certainly have some ramifications for local government and planning enforcement officers.
Also of significance is a recent decision of a magistrate who was asked to consider section 126(2) of the Planning and Environment Act 1987 and whether the prosecution was required to prove intention to make out the offence.
In terms of Environmental Health, the recent floods in Victoria pose new and significant health issues for the industry at a time when the amendments to the Food Act 1984 are still being implemented.
