About Elisabeth

Elisabeth is a skilled litigator who acts in a variety of disputes on behalf of public sector and private clients, often appearing as a solicitor advocate. She has particular expertise in administrative law, inquiries, investigations, statutory interpretation and regulatory disputes. Elisabeth is a practically minded litigator with a deep knowledge of government and regulatory process, as well as a large body of experience in conducting negotiations on behalf of government bodies and statutory authorities.

Elisabeth recently completed a 12-month secondment to the Department of Environment, Land, Water and Planning. From 2010 to 2015, Elisabeth was a member of the Maddocks' Public Law team, during which time she advised government bodies on their powers and functions, and conducted hundreds of prosecution and enforcement proceedings.

Experience

  • A large statutory water corporation

    Appearing as a solicitor advocate, successfully defended a claim brought under the Australian Consumer Law and Fair Trading Act 2012 on jurisdictional grounds that arose in the particularly statutory context of the dispute.

  • Victorian Department of Environment, Land, Water and Planning

    Leading the legal team advising the State Government on the renewal of the Regional Forests Agreement (including sitting on the inter-departmental Victorian Whole of Government Steering Committee), and appeared as a delegate of the State in negotiations with the Commonwealth.

  • Victorian Department of Environment, Land, Water and Planning

    Advising the Department in relation to various aspects of the Royal Commission into the 2019 – 2020 bushfires, as well as the related Victorian Inspector-General for Emergency Management inquiry.

  • The Roads Corporation (VicRoads)

    Advising in relation to the exercise of its statutory powers as the Victorian road safety regulator, and acting on disputes arising under the Road Safety Act 2009, including merits and judicial review proceedings. Elisabeth has also provided advice in relation to proposed legislative amendments, and regularly appears as a solicitor advocate on behalf of VicRoads. In 2018, Elisabeth successfully prosecuted a judicial review appeal of a decision of the Magistrates’ Court of Victoria which has established an important precedent in Victoria in relation to the scope of the Magistrates’ Court of Victoria’s powers when determining appeals brought under the Road Safety Act 2009.

  • Kingston City Council

    Acting in a Supreme Court ejectment proceeding to recover possession of unlawfully occupied Crown Land that involved complex questions of statutory interpretation with respect to the powers of committees of management under the Crown Land (Reserves) Act 1978
