Michael has extensive experience acting in the areas of restructuring and insolvency, including formal corporate and personal insolvency appointments, security enforcement, recovery strategies and complex commercial litigation.

Michael's insolvency expertise extends to acting for insolvency practitioners, directors, lenders and corporations. He has acted on large scale and complex insolvencies involving ASX listed companies, managed investment schemes, property development companies and retailers across a wide range of industries.

As a litigator, Michael has acted in numerous high profile class actions and funded recovery actions in respect of ASX listed companies, managed investment schemes and providers of financial advice and services. This experience extends to shareholder disputes, fraud, negligence, real property disputes, directors’ duties and insolvency related recovery actions, including urgent applications to obtain 'freezing orders' to preserve assets.

Experience

  • Restructuring & Insolvency

    Acting for liquidators in the complex insolvency of a property development company including dealing with claims by numerous registered mortgagees, caveat lenders and purchasers, including a number of properties involving multiple purchasers who had paid significant deposits to purchase one and the same property.

  • Litigation

    Acting for a major private company in urgent recovery of a circa $10m fraud by a senior staff member, including obtaining urgent injunctive relief against various properties owned by the fraudster and various family members and related corporate entities.

  • Restructuring & Insolvency

    Acting for secured creditors on the restructure of a major technology start up with a view to eventual listing on the ASX, including appearing an urgent injunctive relief sought by various aggrieved shareholders and lenders.

  • Litigation

    Acting for insolvency practitioners in various multi-million dollar recovery actions against directors and various related entities, including insolvent trading, uncommercial transactions, unreasonable director-related transactions and unfair preferences.
