Maddocks was appointed by Marrickville City Council (now known as Inner West Council) to advise on the project delivery agreement for the redevelopment of the Marrickville Hospital Site.
The project involved the design and development of a new community hub facility, as well as the granting of development rights to a private developer over the remainder of the project site.
The main issues associated with the project were:
- how to best structure and stage the overall project (including the subdivision and transfer of parts of the site to a private development) in order to minimise the risk of ‘land banking’ by the private developer
- how to structure the project and associated arrangements with private developers in order to minimise the risks to Council associated with residential building work and associated statutory warranties under the Home Building Act 1989 (NSW).
We provided Council with advice as to how to structure the contracting and land transfer arrangements under a project delivery agreement in a manner than minimised risks to Council. Maddocks drafted and negotiated the project delivery agreement on Council’s behalf.
