Experience
-
Restructure
Advising a client on a complex international restructure. This involved creating a redundancy plan and preparing documentation to be provided to employees.
-
Unfair dismissal
Successfully defending an unfair dismissal claim that was lodged by an employee who was dismissed after she failed to comply with a lawful and reasonable direction of her employer. This involved providing strategy advice, preparing submissions and witlessness statements, and instructing Counsel during the hearing before the Fair Work Commission.
-
Post-employment obligations
Providing advice on the enforcement of post-employment obligations, including non-compete and non-solicitation obligations. Preparing letters to former employee and new employer enforcing obligations, which resulted in the new employer withdrawing its offer of employment.
-
Employment contracts and workplace policies
Preparing employment contracts for executive employees and preparing workplace policies, including acceptable workplace behaviour, conflict of interest, use of company property and complaints and grievance policy.
