Land Lease

Legal solutions that support developers and operators in the creation and management of land lease communities across Australia.

Our Land Lease Expertise

Developers and operators of land lease communities face a unique set of challenges, from navigating complex regulatory frameworks that differ across jurisdictions and ensuring an effective and compliant structure, through to managing high volume conveyancing and leasing. Whether you're a well-established operator expanding your portfolio or a developer entering the land lease market for the first time, success in this asset class demands legal advisors who understand the intricacies of the model and can deliver practical, scalable solutions.

Maddocks brings over 15 years of experience advising private developers and investors on land lease communities, including involvement in the structuring of the first ever Australian land lease model. This, coupled with our longstanding track record advising on delivery of master planned communities, we understand the risks and opportunities and our multidisciplinary team can guide you through these to ensure project success.

We advise nationally on:

  • Business structuring and investment frameworks to optimise returns and manage risk
  • Tax and social security considerations to ensure resident eligibility and financial viability
  • Planning, zoning and permitting to streamline approvals and development timelines
  • Volume leasing and conveyancing supported by our digital platforms for operational efficiency
  • Embedded network establishment and energy regulation to enable sustainable infrastructure
  • Consumer agreements and compliance across multiple jurisdictions
  • Dispute resolution and stakeholder management including regulators, residents and advocacy groups
