The purpose of this publication is to keep you up to date with decisions that impact local councils in NSW.
In this edition we consider cases regarding:
- a lessee’s compensation claim following a compulsory acquisition, for construction, fit-out, and other physical relocation costs;
- when a development application will be considered to have been ‘made’ for the purposes of the planning framework;
- site-specific development control plans, concept development applications and adaptive reuse of existing buildings;
- change of use where no physical works are proposed;
- civil enforcement where a development consent has ceased to be in force;
- the assessment of market value in determining compensation for a compulsory acquisition where an owner’s actions have caused a decrease in the acquired property’s value.
