Welcome to the first edition of the NSW Local Government Court Reporter for 2024.

The purpose of this publication is to keep you up to date with decisions that impact local councils in NSW.

In this edition we consider cases regarding:

  • a lessee’s compensation claim following a compulsory acquisition, for construction, fit-out, and other physical relocation costs;
  • when a development application will be considered to have been ‘made’ for the purposes of the planning framework;
  • site-specific development control plans, concept development applications and adaptive reuse of existing buildings;
  • change of use where no physical works are proposed;
  • civil enforcement where a development consent has ceased to be in force;
  • the assessment of market value in determining compensation for a compulsory acquisition where an owner’s actions have caused a decrease in the acquired property’s value.
