Franchising in Australia is big business and the Australian franchising regulatory landscape is frequently changing. The franchising sector was recently the subject of an extensive parliamentary inquiry which considered the operation and effectiveness of Australian franchising laws. The inquiry’s findings were published in the Fairness in Franchising report on 14 March 2019 (Report). The Report exceeds 300 pages in length and contains over 71 recommendations of varying significance.
Currently, none of the Report’s recommendations have been enacted as law and we do not anticipate the Australian Government will take decisive action on the Report in 2019. Nonetheless, it is important for franchising participants to have a holistic understanding of the Australian franchising sector, including the Report and its potential to significantly change Australia’s franchising regulatory landscape in the future.
