About Duncan

Duncan acts for a range of construction industry participants, including developers, contractors and engineers in multiple jurisdictions. He has acted in, and advised on matters in NSW, QLD, VIC, WA and NZ.

Duncan has experience acting in various supreme court proceedings, arbitrations, expert determinations and security of payment adjudications. He also has over 10 years of experience working in the construction industry on residential, commercial and defence projects.

Experience

• Tier 2 Contractor

  Acting for a tier 2 contractor, in 8 separate sets of proceedings in the Supreme Court of NSW, involving allegations of defective building work, including the supply and installation of combustible cladding. These proceedings also involve alleged breaches of the duty of care in the Design and Building Practitioners Act 2020 (NSW), and the statutory warranties in the Home Building Act 1989 (NSW).

• Commonwealth of Australia

  Acting for the Commonwealth of Australia in relation to three separate agreements for lease in NSW, VIC and WA, providing advice in relation to various claims for delay costs and variations relating to fit-out works performed by contractors and landlords.

• International clients

  Acting for a large international contractor, advising in relation to disputes over liquidated damages with the principals of two separate solar farms.
