Marelda is the Practice Team Leader for the Maddocks Banking, Restructuring & Insolvency team in Victoria.

Marelda has extensive experience advising directors, government agencies, financial institutions, and insolvency practitioners in insolvency, banking recovery and restructuring matters.

Marelda advises on a wide range of banking and insolvency processes, including bankruptcy, corporate insolvency, securities enforcement, asset realisation and commercial litigation. She has extensive experience in acting for shareholders in shareholder oppression proceedings. She also acts on behalf of several banks in recovery of corporate and commercial debts.

Her work has led her to be recognised as a recommended Restructuring and Insolvency Lawyer in Doyle’s Guide, Legal 500 and Best Lawyers and as a Leading Commercial Litigation & Dispute Resolution Lawyer in Doyle’s Guide.

Experience

  • Hastie Group insolvency

    Acting for various Watpac entities in relation to claims brought against approximately 30 principal contractors by the liquidators of various Hastie Group entities. The proceedings involve complicated insolvency and construction issues relating to set-off and the interaction of provisions of the Corporations Act 2001 (Cth) and Personal Property Securities Act 2009 (Cth).

  • Secured creditors

    Advising in all aspects of security enforcement and insolvency, including the appointment of receivers and managers, investigating accountants and voluntary administrators.

  • Shareholder oppression proceedings

    Marelda is highly experienced in acting for majority and minority shareholders and in achieving positive outcomes for clients (see for example, Grubb & Ors V Doquile Perrett Meade Holdings Pty Ltd & Ors S ECI 2020 04275).

  • Directors duties litigation

    Acting on behalf of directors of public and private companies in statutory and common law duties litigation (see for example, Australian Securities & Investments Commission v Clarke [2018] HCA 63.)

  • Insolvency-related regulatory advice

    Acting on behalf of state regulators in relation to corporate insolvency matters.

  • Corporate and personal insolvency

    Acting on behalf of liquidators and bankruptcy trustees in respect of voidable transactions, large-scale recovery proceedings and provision of advice.
