Kevin advises on large-scale government projects and high-value private sector transactions. Kevin has provided strategic advice to the State of Victoria (including at ministerial and department head levels) in connection with a number of the highest value projects and is recognised by his clients as a leading adviser in relation to government procurement. In the private sector he regularly advises clients in connection with sales of companies and businesses, corporate restructuring and commercial contracts and transactions.

Experience

  • Department of Transport
    Acting for the Department of Transport in relation to the School and Regional Bus Contract Review project. This matter involved the negotiation of bus service contracts. In this project Kevin advised on contract structure and the negotiation strategy, drafted all contracts, process deeds, guarantees, security deeds and related documents, undertook negotiations with counterparties and industry representatives and prepared final documentation for execution.
  • Department of Justice and Community Safety
    Advising the Department of Justice and Community Safety on three major procurement projects related to road safety cameras and infringement processing. Kevin provided strategy advice, preparing contracts and related documents, reviewing RFTs and specifications, negotiating with tenderers and producing the final contracts that were executed by the Attorney General and the Minister for Police.
  • Department of Education
    Acting for the Department of Education in a number of procurement projects including a major procurement relating to the provisions of special school bus services across Victoria. This project required the negotiation of over 300 contracts with suppliers providing bus services across the State. We advised on project strategy. Prepared to contracts and related legal documents, undertook negotiations with counterparties and industry representatives and prepared final documentation for execution. The total contract value for the project exceeded $400 million.
  • Justice Health
    Acting for Justice Health in a number of significant the procurement projects over a period of 4 years including contracts relating to: • provision of primary health services at publicly operated adult prisons; • provision of program services at publicly operated adult prisons; • provision of primary health service at youth justice facilities; and • provision of rehabilitation programs at youth justice facilities. Total contract value across this suite of contracts exceeds $200 million
  • Major accounting firm
    Advising one of Australia’s largest accounting firms in relation to a project to replace all existing system for finance, billing, document management and CRM with a cloud based SAAS solution. We reviewed and advised on supplier agreements and negotiated agreed outcomes with all suppliers, including Salesforce, iManage and FinancialForce. This project involved negotiating and agreeing 6 different agreements with vendors located in the US, UK, Singapore and Australia. Negotiations were robust and detailed as our client required a number of changes to the standard form contracts provided by the vendors.
